Compliance with I.N.S. Employment Eligibility Regulations
In order to comply with the Immigration Reform and Control Act of 1986, the Immigration and Naturalization Service (INS) has developed regulations to implement the law. The purpose of this law is to preserve jobs for those who are legally entitled to hold them, regardless of their nationality. The law requires that every employer verify both identity and employability of every person hired. Failure by the employer to perform such verification may result in both civil and criminal penalties.
The EMPLOYMENT ELIGIBILITY VERIFICATION FORM I-9 has been developed by the INS for this verification process. When completing the FORM I-9, the employee must provide supporting documentation, which will be noted on the FORM I-9 and kept in the employee’s file for audit purposes. The Office of Human Resources will be responsible for verifying the work eligibility of all Trinity University employees.
By federal law, employees must present proof of eligibility to work in the U.S. within 72 hours of their date of hire. Department and program supervisors are urged to impress upon their employees the importance of this step in the hiring process. Failure by the employee to fill out the FORM I-9 and/or to present supporting documents will result in immediate termination of employment with Trinity University.
